Description

Over one hundred regulations related to restricting, disclosing, or testing per- and polyfluoroalkyl substances (PFAS) in consumer products have been adopted or introduced in more than thirty states across the United States. As a result, consumer product companies face significant challenges when interpreting and implementing compliance measures.

In this session, we will examine shared language in state PFAS regulations while focusing on the differences that create compliance challenges. Participants will gain clarity on issues such as what constitutes a "product," how "PFAS" are defined across jurisdictions, and the difference between intentional and unintentional PFAS uses. Using Minnesota as a case study, we will dissect jurisdictional complexities related to products sold to consumers within a state, products moving across state borders, and third-party distribution scenarios. Furthermore, we will identify supplier communication challenges and highlight strategies to enhance data collection across complex supply chains, as well as recommend testing approaches to determine the presence of PFAS in consumer products. Participants will leave with practical tools for navigating the evolving PFAS regulatory environment.
